अनिवार्य सब्जेक्ट को भी ऑप्शनल के समकक्ष माना
बीकानेर, @MaruSangram। ग्रेड थर्ड टीचर भर्ती 2022 में अब उन कैंडिडेट्स को भी नियुक्ति मिल सकेगी, जिन्होंने अंग्रेजी, हिन्दी, पंजाबी को ऑप्शनल (वैकल्पिक) के बजाय अनिवार्य सब्जेक्ट के रूप में पढ़ा है।
हाईकोर्ट ने शनिवार को फैसला सुनाया कि 3 साल की ग्रेजुएशन के दौरान पढ़े गए सब्जेक्ट्स को अब ऑप्शनल सब्जेक्ट्स के समकक्ष माना है। कोर्ट ने ऐसे सभी कैंडिडेट्स को नियुक्ति प्रक्रिया में शामिल रखने के आदेश दिए हैं।
लेवल 2 की भर्ती में अंग्रेजी, हिन्दी, पंजाबी सब्जेक्ट्स ऑप्शनल के रूप में होने पर ही पात्र माना गया था। कैंडिडेट्स ने दलील दी थी कि जिस सब्जेक्ट को शिक्षा विभाग ऑप्शनल के रूप में मांग रहा है, हम उन सब्जेक्ट्स को अनिवार्य विषय के रूप में पढ़ चुके हैं।
नियुक्ति के लिए इन विषयों की पढ़ाई ग्रेजुएशन में जरूरी है। इस शर्त को कैंडिडेट्स पूरा कर रहे हैं। अब उन्हें ऑप्शनल या अनिवार्य सब्जेक्ट को आधार मान कर अयोग्य घोषित नहीं किया जा सकता।
सैकड़ों कैंडिडेट्स को बड़ी राहत
याचिकाकर्ताओं के वकील सुशील बिश्नोई ने बताया कि अब लेवल 2 में अंग्रेजी, हिंदी, पंजाबी विषय के कैंडिडेट्स की नियुक्ति का रास्ता साफ हो गया है।
मंजू बाला और अन्य याचिकाओं पर फैसला देते हुए जस्टिस अरुण भंसाली की अदालत ये निर्णय दिया है। बिश्नोई ने बताया कि इस आदेश के बाद सैकड़ों कैंडिडेट्स को बड़ी राहत मिलेगी। अब शिक्षा निदेशालय और भर्ती एजेंसी को भविष्य में होने वाली वैकेंसी में भी इसका ध्यान रखना होगा।
क्या था विवाद
एक्सपर्ट वेदपाल धानोठी ने बताया कि राजस्थान के सीमावर्ती जिलों से आने वाले स्टूडेंट्स पड़ोसी राज्य पंजाब, हरियाणा, दिल्ली, यूपी, एमपी, गुजरात से ग्रेजुएशन करते हैं। इन राज्यों में भाषाई विषयों के रूप में अंग्रेजी, हिंदी, गुजराती और पंजाबी अनिवार्य सब्जेक्ट के रूप में पढ़ाए जाते हैं। साथ ही इनके नंबर भी फाइनल स्कोरिंग में ऑप्शनल विषय के समान जुड़ते हैं।
जबकि राजस्थान में अनिवार्य विषय केवल एक साल क्वालीफाई सब्जेक्ट में रूप में पढ़ाया जाता है। इसके नंबर भी फाइनल स्कोरिंग या ग्रेडिंग में नहीं जुड़ते हैं।
मामले में हाईकोर्ट और सुप्रीम कोर्ट पिछली भर्तियों (2016 और 2018) में भी ऐसे कैंडिडेट्स को पात्र करार दे चुका है। इसके साथ ही निदेशालय ने उनको नियुक्तियां भी दी हैं।
जबकि वर्तमान रीट भर्ती में डॉक्यूमेंट्स वेरिफिकेशन के दौरान ग्रेजुएशन में अंग्रेजी, हिंदी, और पंजाबी ऑप्शनल सब्जेक्ट न होने के कारण फिर से अपात्र घोषित कर दिया था।
धानोठी के अनुसार राजस्थान के सीमावर्ती जिलों में ऐसे अभ्यर्थियों की संख्या सैकड़ों में हैं।

The High Court on Saturday ruled that the subjects studied during 3 years of graduation are now considered equivalent to optional subjects. The court has ordered to keep all such candidates involved in the appointment process.
In Level 2 recruitment, English, Hindi, Punjabi subjects were considered eligible only if they were optional. The candidates had argued that the subjects which the Education Department is demanding as optional, we have already studied those subjects as compulsory subjects.
For appointment, study of these subjects is necessary in graduation. Candidates are fulfilling this condition. Now they cannot be disqualified on the basis of optional or compulsory subject.
Big relief to hundreds of candidates
Petitioners’ lawyer Sushil Bishnoi said that now the way has been cleared for the appointment of candidates with English, Hindi and Punjabi subjects in Level 2.
Justice Arun Bhansali’s court has given this decision while giving verdict on Manju Bala and other petitions. Bishnoi said that after this order, hundreds of candidates will get great relief. Now the Directorate of Education and the recruitment agency will have to take care of this in future vacancies as well.

Expert Vedpal Dhanothi said that students coming from the border districts of Rajasthan graduate from the neighboring states of Punjab, Haryana, Delhi, UP, MP, Gujarat. In these states, English, Hindi, Gujarati and Punjabi are taught as compulsory subjects as linguistic subjects. Also, their marks are also added in the final scoring like those of optional subjects.
Whereas in Rajasthan the compulsory subject is taught only in the form of qualifying subject for one year. Its marks also do not count towards final scoring or grading.
In this case, the High Court and the Supreme Court have declared such candidates eligible in the previous recruitments (2016 and 2018) as well. Along with this, the Directorate has also given appointments to them.
While in the current REET recruitment, during the documents verification, he was again declared ineligible due to non-availability of English, Hindi, and Punjabi optional subjects in graduation.
According to Dhanothi, the number of such candidates in the border districts of Rajasthan is in hundreds.
