राजस्थान के ये हज़ारों कर्मचारी अब आएंगे कानून के दायरे में, जानें क्या है गहलोत सरकार की बड़ी कवायद…..

जयपुर, @MaruSangram। राज्य सरकार ने प्रदेश में ऑनलाइन आर्डर पर फूड या अन्य प्रॉडक्ट घर-घर पहुंचाने वाले गिग वर्कर्स को कानूनी दायरे में लाने का निर्णय किया है। इसके तहत शुक्रवार को राज्य विधानसभा में राजस्थान प्लेटफार्म आधारित गिग कर्मकार, रजिस्ट्रीकरण और कल्याण विधेयक 2023 पेश किया गया है। इसे सोमवार को चर्चा के बाद पारित किया जाएगा।

ये होते गिग वर्कर:

बिजनेस में कंपनियां कुछ काम स्थायी कर्मचारी के बजाए गैर स्थायी कर्मचारी से कराती है। इन कामों के लिए कंपनी काम के आधार पर भुगतान करती है। ये कार्मिक कंपनी से लंबे समय से जुड़े होते है लेकिन इनकी गिनती स्थाई या ठेके कार्मिकों में नहीं होती है।
गिग वर्कर के तौर पर काम करने वाले कर्मचारी और कंपनी के बीच एक समझौता होता है। इस समझौता के तहत कंपनी की कॉल पर कार्मिक को काम करना होता है। इस काम के बदले ही कंपनी गिग वर्कर को भुगतान करती है।
इन कर्मचारियों को कंपनी के स्थायी कर्मचारियों की तरह वेतन-भत्ते आदि का लाभ नहीं मिलता है। इस तरह का काम करने का कोई समय तय नहीं होता है और कार्मिक को किसी भी समय काम के लिए कॉल किया जा सकता है।
देश में ऑनलाइन कारोबार बढ़ने के बाद गिग वर्कर्स की संख्या में भी बढ़ोतरी हुई है। एक अनुमान के अनुसार वर्तमान में इनकी संख्या करीब दस करोड़ से अधिक हो गई है।
ये वर्कर मुख्य रूप से ऑनलाइन फूड प्लेटफॉर्म, ई-कॉमर्स कंपनी और सामान की डिलीवरी और ड्राइविंग के कार्य कर रहे हैं।

इस कारण लाया गया है विधेयक:
दरअसल, राज्य सरकार का मानना है कि वर्तमान आर्थिक परिदृश्य में गिग कार्य के जरिए कम कौशल वाली जनसंख्या के एक बड़े भाग को रोजगार उपलब्ध कराया जा सकता है। इसमें मुख्य रूप से परिवहन और फूड डिलिवरी में इनका योगदान लगातार बढ़ रहा है। वर्तमान में बड़ी संख्या में कार्यरत इन वर्कर की सेवाओं को लेकर कोई कानून या नियम नहीं बने हुए है।

ये है कारण:
अर्थव्यवस्था में बड़ा योगदान देने वाले गिग वर्कर वर्तमान में असंगठित वर्कर का ही एक भाग है। साथ ही कानून नहीं होने के कारण ये लोग श्रम विधियों के दायरे में भी नहीं आत हैं।

इन्हे उस स्तर का संरक्षण भी नहीं मिल पाता जो कि पारम्परिक कार्मिकों को मिलता है। इस प्लेटफार्म में होने वाले विवादों को लेकर प्रभावी समाधान तंत्र उपलब्ध नहीं है। इसको देखते हुए राज्य सरकार ने गिग कार्मिकों को संरक्षित करने और सामाजिक सुरक्षा के फायदे पहुंचाने का निर्णय किया है।

ये किया जाएगा:
सरकार की ओर से प्रस्तावित विधेयक में इन गिग वर्कर का अधिकारिक रूप से रजिस्ट्रेशन किया जाना तय किया गया है। साथ ही इनके लिए एक कल्याण बोर्ड का गठन करने और कल्याण निधि की स्थापना की जाएगी। इसके लिए गिग कर्मकार कल्याण फीस प्रभारित करने और संग्रहित करने का भी निर्णय किया गया है।

ये होंगे विधानसभा में विधायी कार्य:
राज्य विधानसभा का वर्तमान सत्र सोमवार को भी चलेगा, इस संबंध में विधानसभा की कार्य सलाहकार समिति की बैठक में निर्णय किया गया है।

सोमवार को राज्य सरकार की और से चार विधेयक पारित कराए जाएंगे। इसमें राजस्थान प्लेटफार्म आधारित गिग कर्मकार—रजिस्ट्रीकरण और कल्याण— विधेयक 2023, कोटा विकास प्राधिकरण विधेयक, उदयपुर विकास प्राधिकरण विधेयक, गांधी वाटिका न्यास जयपुर विधेयक शामिल है।

Jaipur, @MaruSangram. The state government has decided to bring the gig workers who deliver food or other products door-to-door in the state under the legal ambit. Under this, the Rajasthan Platform Based Gig Workers, Registration and Welfare Bill 2023 has been introduced in the state assembly on Friday. It will be passed after discussion on Monday.

These are gig workers:
In business, companies get some work done by non-permanent employees instead of permanent employees. For these works, the company pays on the basis of work. These personnel are associated with the company for a long time but they are not counted in permanent or contract personnel.

There is an agreement between the employee and the company working as a gig worker. Under this agreement, the personnel have to work on the call of the company. In return for this work, the company pays the gig worker.

These employees do not get the benefits of salary and allowances etc. like the permanent employees of the company. There is no fixed timing for this type of work and personnel can be called for work at any time. After the increase in online business in the country, the number of gig workers has also increased. According to an estimate, at present their number has exceeded ten crores. These workers are mainly working on online food platforms, e-commerce companies and delivery and driving of goods. In fact, the state government believes that in the current economic scenario, gig work can provide employment to a large section of the low-skilled population. In this, mainly their contribution in transport and food delivery is continuously increasing. At present, there is no law or rule regarding the services of these workers employed in large numbers. Here is the reason:
Gig workers, currently a major contributor to the economy, are only a part of the unorganized workforce. Also, due to lack of law, these people do not even come under the ambit of labor laws.

They do not even get the same level of protection that the traditional workers get. There is no effective resolution mechanism available for disputes arising in this platform. In view of this, the state government has decided to protect the gig workers and provide social security benefits.

This will be done:
In the bill proposed by the government, it has been decided to officially register these gig workers. Along with this, a welfare board will be constituted and a welfare fund will be established for them. For this, it has also been decided to charge and collect gig worker welfare fees.

These will be the legislative business in the assembly:
The current session of the State Legislative Assembly will continue on Monday also, a decision has been taken in this regard in the meeting of the Business Advisory Committee of the Legislative Assembly.

On Monday, four bills will be passed by the state government. This includes the Rajasthan Platform-Based Gig Workers-Registration and Welfare-Bill 2023, Kota Development Authority Bill, Udaipur Development Authority Bill, Gandhi Vatika Nyas Jaipur Bill.
