हाईकोर्ट ने स्पा में क्रॉस-जेंडर मसाज के खिलाफ दायर याचिका की खारिज…..

नई दिल्ली, @MaruSangram। दिल्ली हाईकोर्ट ने स्पा और मसाज सेंटर्स में क्रॉस-जेंडर मसाज पर प्रतिबंध लगाने वाली जनहित याचिका खारिज कर दी है।

कार्यवाहक मुख्य न्यायाधीश मनमोहन और न्यायमूर्ति मनमीत सिंह अरोड़ा की अगुवाई वाली खंडपीठ ने बताया कि यह मामला पहले से ही एकल न्यायाधीश के विचाराधीन है।

अनुज मल्होत्रा द्वारा दायर जनहित याचिका में इस बात का अनुरोध किया गया था कि दिल्ली सरकार स्पा या मसाज सेंटरों की रिकॉर्डिंग नियमित रूप से दिल्ली महिला आयोग के साथ साझा करे।

मल्होत्रा के वकील ने तर्क दिया कि क्रॉस-जेंडर मसाज दिल्ली सरकार द्वारा 2021 में जारी किए गए “दिल्ली में स्पा/मसाज केंद्रों के संचालन के लिए दिशानिर्देश” का उल्लंघन है।

वकील ने कहा, ”स्‍पा में इस तरह की सर्विस अक्सर बंद कमरों में प्रदान की जाती है, जो दिशानिर्देशों का उल्लंघन है और संभावित रूप से वेश्यावृत्ति को बढ़ावा देती है।”

पीठ ने कहा कि एक जस्टिस पहले से ही इसकी वैधता की जांच कर रहे हैं, इसलिए इस पर विचार नहीं हो सकता।

New Delhi, @MaruSangram. The Delhi High Court has dismissed a PIL seeking a ban on cross-gender massage in spas and massage centers.

A division bench headed by Acting Chief Justice Manmohan and Justice Manmeet Singh Arora said that the matter is already pending with a single judge.

The PIL filed by Anuj Malhotra requested that the Delhi government regularly share the recordings of spas or massage centers with the Delhi Commission for Women.

Malhotra’s lawyer argued that cross-gender massage is a violation of the “Guidelines for Operation of Spas/Massage Centers in Delhi” issued by the Delhi government in 2021.

“Such services are often provided in closed rooms in spas, which is in violation of guidelines and potentially promotes prostitution,” the lawyer said.

The bench said one judge is already examining its legality and hence it cannot be considered.
