नई दिल्ली, @Marusangram। कांग्रेस सांसद राहुल गांधी को बड़ा झटका लगा है। उनकी संसद सदस्यता रद्द कर दी गई है। वह केरल के वायनाड से सांसद हैं। एक दिन पहले गुजरात में सूरत कोर्ट ने राहुल गांधी के बयान को लेकर 2 साल की सजा सुनाई थी, साथ ही ऊपरी अदालत में चुनौती के लिए 30 दिनों की मोहलत भी दी थी। लेकिन मिडिया सूत्रों से मिली जानकारी अनुसार अभी अभी राहुल गांधी की संसद सदस्यता रद्द कर दी गई है।

वायनाड से कांग्रेस सांसद राहुल गांधी की संसद सदस्यता रद कर दी गई है। शुक्रवार को लोक सचिवालय की ओर से इस मामले में पत्र भी जारी कर दिया गया है। बता दें कि मानहानि केस में सूरत की कोर्ट ने गुरुवार को उन्हें 2 साल की सजा सुनाई थी। राहुल गांधी ने 2019 में कर्नाटक की सभा में मोदी सरनेम को लेकर बयान दिया था। उन्होंने कहा था- सभी चोरों का सरनेम मोदी क्यों होता है।
लोकसभा सचिवालय के संयुक्त सचिव पीसी त्रिपाठी की ओर से आज जारी किए गए पत्र में कहा गया है कि वायनाड निर्वाचन क्षेत्र का प्रतिनिधित्यव करने वाले श्री राहुल गांधी को लोकसभा की सदस्यता से अयोग्य ठहराया जाता है। भारत के संविधान के अनुच्छेद 102 (I)(e) के प्रावधानों एवं जनप्रतिनिधि अधिनियम 1951 की धारा 8 के तहत उनकी यह अयोग्यता सजा सुनाए जाने की तारीख यानी 23 मार्च 2023 से प्रभावी होगी। बता दें कि किसी भी निर्वाचित प्रतिनिधि को किसी भी अपराध के लिए दो साल या उससे अधिक की सजा सुनाए जाने पर जनप्रतिनिधित्व अधिनियम, 1951 के तहत तत्काल अयोग्यता का सामना करना पड़ता है। अधिनियम का एक प्रावधान जिसने अयोग्यता से तीन महीने की सुरक्षा प्रदान की थी, उसे 2013 में सुप्रीम द्वारा अल्ट्रा वायर्स के रूप में रद्द कर दिया गया था। लिली थॉमस मामले में न्यायालय।राहुल गांधी के मामले में सूरत की अदालत ने उनकी कानूनी टीम के अनुरोध पर 30 दिनों के लिए उनकी सजा को निलंबित कर दिया ताकि उन्हें फैसले को चुनौती देने का अवसर मिल सके।

In a letter issued today by PC Tripathi, Joint Secretary, Lok Sabha Secretariat, it has been said that Mr. Rahul Gandhi, representing the Wayanad constituency, is disqualified from the membership of the Lok Sabha. This disqualification under the provisions of Article 102 (I) (e) of the Constitution of India and Section 8 of the Representation of the People Act, 1951 will be effective from the date of sentencing i.e. March 23, 2023. Explain that any elected representative faces immediate disqualification under the Representation of the People Act, 1951, if sentenced to two years or more for any offence.
