साल 2010 से पहले नियुक्त हजारों शिक्षकों के लिए शिक्षक पात्रता परीक्षा (टीईटी) से छूट की उम्मीदों पर केंद्र सरकार ने फिलहाल पूर्ण विराम लगा दिया है.। लोकसभा में स्पष्ट किया गया कि पात्रता परीक्षा शिक्षक बनने की न्यूनतम अनिवार्य योग्यता है और इससे छूट देने या पुरानी नियुक्तियों के लिए अलग व्यवस्था बनाने का सरकार का कोई प्रस्ताव नहीं है। केंद्र ने अपने रुख के समर्थन में सीधे सुप्रीम कोर्ट के हालिया निर्णयों का हवाला दिया।
यह मुद्दा सोनीपत सांसद सतपाल ब्रह्मचारी और हिसार सांसद जय प्रकाश ने लोकसभा में उठाया था। उन्होंने पूछा था कि 2010 से पहले उस समय के नियमों के तहत नियुक्त शिक्षकों के लिए क्या कोई विशेष प्रावधान किया जाएगा, क्योंकि उनकी नियुक्ति के समय शिक्षक पात्रता परीक्षा लागू ही नहीं था।
शिक्षा राज्य मंत्री जयंत चौधरी ने लिखित उत्तर में कहा कि शिक्षक भर्ती और सेवा शर्तें राज्यों के अधिकार क्षेत्र का विषय हैं, लेकिन शिक्षा का अधिकार (आरटीई) अधिनियम के तहत आने वाले विद्यालयों में पात्रता परीक्षा न्यूनतम अनिवार्य योग्यता घोषित किया जा चुका है। यह व्यवस्था सुप्रीम कोर्ट के निर्णयों से भी पुष्ट हो चुकी है। इसलिए शिक्षक पात्रता परीक्षा से छूट देने या वैकल्पिक पात्रता लागू करने का फिलहाल कोई प्रश्न नहीं उठता।
राहत केवल समय में, नियम में नहीं
सरकार ने स्पष्ट किया कि सुप्रीम कोर्ट ने पहली सितंबर, 2025 के निर्णय में पात्रता परीक्षा की अनिवार्यता बरकरार रखी थी। बाद में 29 मई, 2026 को समीक्षा याचिकाओं पर सुनवाई करते हुए अदालत ने केवल अंतिम समयसीमा बढ़ाई। अब जिन शिक्षकों को पात्रता परीक्षा उत्तीर्ण करना है, उन्हें 31 अगस्त, 2028 तक यह योग्यता हासिल करने का अवसर मिलेगा। यानी अदालत ने नियम में कोई ढील नहीं दी, केवल समय बढ़ाया है।
राज्यों को साल में दो बार परीक्षा कराने की सलाह
केंद्र ने सदन को बताया कि सुप्रीम कोर्ट ने राज्यों और संबंधित परीक्षा प्राधिकरणों को सलाह दी है कि शिक्षक पात्रता परीक्षा नियमित रूप से आयोजित की जाए और संभव हो तो हर वर्ष दो बार परीक्षा कराई जाए। अदालत का मानना है कि इससे पात्र अभ्यर्थियों और कार्यरत शिक्षकों को समय पर योग्यता हासिल करने का पर्याप्त अवसर मिलेगा।
हजारों शिक्षकों की उम्मीदों को झटका
लोकसभा में सरकार के जवाब से साफ हो गया है कि 2010 से पहले नियुक्त शिक्षकों के लिए अलग श्रेणी बनाकर पात्रता परीक्षा से छूट देने की मांग फिलहाल स्वीकार नहीं की गई है। इसका सीधा मतलब है कि जिन शिक्षकों पर पात्रता परीक्षा की पात्रता लागू होती है, उन्हें 31 अगस्त, 2028 तक परीक्षा उत्तीर्ण करनी ही होगी। फिलहाल यही उनके लिए उपलब्ध एकमात्र वैधानिक रास्ता है।

The Central Government has put an end to hopes of exemption from the Teacher Eligibility Test (TET) for thousands of teachers appointed before 2010. The Lok Sabha clarified that the eligibility test is the minimum mandatory qualification to become a teacher and the government has no proposal to exempt it or create a separate system for old appointments. The Center directly cited recent Supreme Court decisions to support its stance.
This issue was raised in the Lok Sabha by Sonipat MP Satpal Brahmachari and Hisar MP Jai Prakash. He asked whether any special provisions would be made for teachers appointed before 2010 under the rules in effect at the time of their appointment, as the Teacher Eligibility Test was not in effect at the time of their appointment.
In a written reply, Minister of State for Education Jayant Chaudhary stated that teacher recruitment and service conditions are within the jurisdiction of states, but the eligibility test has been declared the minimum mandatory qualification for schools covered under the Right to Education (RTE) Act. This provision has also been confirmed by Supreme Court decisions. Therefore, there is currently no question of exempting the Teacher Eligibility Test or implementing alternative qualifications.
Relief Only in Time, Not in Rules
The government clarified that the Supreme Court had upheld the requirement of the eligibility test in its September 1, 2025, decision. Later, while hearing review petitions on May 29, 2026, the court only extended the deadline. Now, teachers who need to pass the eligibility test will have the opportunity to obtain it until August 31, 2028. This means that the court has not relaxed the rules, it has only extended the time.
States advised to conduct the exam twice a year
The Central Government informed the House that the Supreme Court has advised states and relevant examination authorities to conduct the Teacher Eligibility Test regularly, and if possible, twice a year. The Court believes this will provide eligible candidates and serving teachers with ample opportunity to obtain the qualification in a timely manner.
Frustrated hopes of thousands of teachers
The government’s response in the Lok Sabha makes it clear that the demand for exemption from the eligibility test by creating a separate category for teachers appointed before 2010 has not been accepted at this time. This means that teachers who are eligible for the eligibility test must pass the exam by August 31, 2028. This is the only legal recourse available to them at present.
