गुजरात की एक अदालत ने कांग्रेस नेता राहुल गांधी को ‘मोदी उपनाम’ (Modi Surname) संबंधी टिप्पणी को लेकर आपराधिक मानहानि के मामले में दोषी ठहराया है। अदालत ने इस मामले में राहुल गांधी को 2 साल की सजा सुनाई है। वहीं सजा मिलने के बाद राहुल गांधी को अदालत से जमानत भी मिल गई। अब वो कोर्ट के फैसले के खिलाफ अपील कर सकते हैं।

- राहुल गांधी के इस बयान के बाद खूब बवाल हुआ। बीजेपी विधायक पूर्णेश मोदी की शिकायत पर गुजरात की एक अदालत में आपराधिक मानहानि मामला दर्ज किया गया था। शिकायतकर्ता ने दावा किया कि विवादास्पद टिप्पणी 2019 के लोकसभा चुनाव से पहले कर्नाटक के कोलार में एक रैली में की गई थी, जिसने पूरे ‘मोदी’ समुदाय को बदनाम किया था।
- शिकायतकर्ता पूर्णेश मोदी ने गुजरात में भूपेंद्र पटेल सरकार के पहले कार्यकाल में मंत्री के रूप में कार्य किया था। दिसंबर 2022 के चुनाव में वो सूरत पश्चिम विधानसभा सीट से फिर से जीतकर आए।
- अदालत में शिकायतकर्ता के वकील ने तर्क दिया कि राहुल गांधी के भाषण की सीडी और एक पेन ड्राइव साबित करते हैं कि उन्होंने वास्तव में रैली में टिप्पणी की थी और उनके शब्दों ने मोदी समुदाय को बदनाम किया था।
- राहुल गांधी के वकील ने तर्क दिया कि कार्यवाही शुरू से ही त्रुटिपूर्ण थी, क्योंकि सीआरपीसी की धारा 202 के तहत कानूनी प्रक्रिया का पालन नहीं किया गया था। उन्होंने यह भी तर्क दिया कि प्रधानमंत्री नरेन्द्र मोदी, न कि पूर्णेश मोदी को इस मामले में एक पीड़ित पक्ष के रूप में शिकायतकर्ता होना चाहिए था, क्योंकि राहुल गांधी के अधिकांश भाषणों में प्रधानमंत्री को लक्षित किया गया था।
- दोनों वकीलों की दलीलों को सुनने के बाद अदालत ने राहुल गांधी को दोषी करार दिया। इस दौरान राहुल गांधी के वकील ने अदालत से कहा कि उनकी सजा कम रखी जाए, क्योंकि उनके बयान से किसी को नुकसान नहीं पहुंचा है। वहीं, राहुल गांधी ने कोर्ट में अपने बयान के लिए माफी मांगने से भी इनकार कर दिया।
- सजा मिलने के बाद राहुल गांधी को तुरंत राहत भी मिल गई। आपरााधिक मानहानि मामले में राहुल गांधी को जमानत भी मिल गई है और 2 साल की सजा पर 30 दिन की रोक लगाई गई है। हालांकि, अदालत ने राहुल गांधी पर 15,000 रुपये का जुर्माना लगाया है।
- मुख्य न्यायिक मजिस्ट्रेट एचएच वर्मा की अदालत ने पिछले शुक्रवार को दोनों पक्षों की अंतिम दलीलें सुनीं और फैसला सुनाने के लिए 23 मार्च की तारीख तय की थी। मामले की सुनवाई के दौरान राहुल गांधी तीन बार कोर्ट में मौजूद रहे थे। वह अपना बयान दर्ज कराने के लिए आखिरी बार अक्टूबर 2021 में पेश हुए और खुद को निर्दोष बताया था।
- राहुल गांधी को 2 साल की सजा मिली है। इससे उनकी संसद सदस्यता खतरे में है। अब सूरत की कोर्ट से सजा की सूचना लोकसभा सचिवालय को भेजी जाएगी। इसके बाद लोकसभा सचिवालय राहुल की सीट (वायनाड) को रिक्त घोषित कर देगा। जमानत मिलते ही राहुल की सजा तो स्थगित हो गई है, लेकिन वो कानूनन दोषी हैं।
- इस पूरे मामले पर अब बीजेपी सांसद सुशील मोदी ने प्रतिक्रिया दी है। उन्होंने कहा, “राहुल गांधी ने चुनाव से पहले सारे मोदी चोर हैं का बयान दिया था, इस बयान के बाद से मोदी सरनेम रखने वाले कई लोगों ने उनके खिलाफ मानहानि का मामला दर्ज कराया। सूरत जिला अदालत के साथ ही बाकी अदालतों में भी उन्हें ऐसे ही सजा सुनाई जानी चाहिए।”

He also argued that Prime Minister Narendra Modi, and not Purnesh Modi, should have been the complainant as an aggrieved party in the case, as most of Rahul Gandhi’s speeches targeted the Prime Minister.
After hearing the arguments of both the lawyers, the court convicted Rahul Gandhi. During this, Rahul Gandhi’s lawyer told the court that his sentence should be reduced as no one was harmed by his statement. At the same time, Rahul Gandhi also refused to apologize for his statement in the court.
